As part of the state’s efforts to stop the spread of Covid-19, Governor Ivey signed an emergency order permitting Alabama attorneys to notarize documents by video on March 26, 2020. The authorized procedure is as follows:
Notaries must be attorneys licensed by the State of Alabama or operating under the supervision of licensed attorneys.
Attorneys may use video conferencing programs, such as Zoom, to notarize signatures and to confirm witnesses who participate virtually through video conferencing as though they were physically present at the signing.
Any person who witnesses as document through video conference technology may be considered an “in person” witness, provided the notarizing attorney confirms the presence and identity of the witness.
Following the video conference, the document is delivered to the attorney
